san jose fire investigators right now looking for the cause of an overnight house fire near the rose garden, the home was vacant at the time and nobody, we're happy to report, was hurt. this one took crews about 20 minutes to finally knock down those flames. it happened a little after 1:30 at a home near dana avenue and mckendrie street. happening right now, a manhunt is on at san jose for parolee who managed to give police the slip despite being locked up in handcuffs and in the back of a police vehicle. "today in the bay's" christie smith is live in san jose with more details on this man's extremely daring escape. christie, good morning. >> reporter: good morning. anthony sanchez is a big guy. to lessen the stress on his shoulders,an jose police linked two pairs of handcuffs together when they put him in handcuffs and put his arms behind his back. he used their kindness to their

advantage and gave san jose police officers the slip yesterday. he stole a police van, they say, from detectives who had just taken him into custody on drug related warrants. police handcuffed him and put him in an unmarked van. an officer was doing paperwork when sanchez slipped the cuffs off, probably moving them under his body and he took off. the keys were in the ignition at the time. fortunately the van was found two hours later where his disappearing act is quite unsettling for neighbors. >> i was kind of shocked. you know, who can do that? big guy. how can he get out of -- we're kind of don't know what to think. kind of scary. >> reporter: san jose police say there were no weapons in that van. anthony sanchez is 5'8" to 5'10"

tall, he was last seen wearing black sweats and a sweatshirt. he's not considered dangerous but police say it's unfortunate this was just a probation violation which would not have meant too much jail time but now when he's caught he may be facing a whole new case. reporting live in san jose, christie smith, "today in the bay." >> 5:03. new details are expected today in a triple murder in sonoma county. a victim's brother found the three men shot to death inside a home on tuesday afternoon. investigators are linking the killings to an illegal marijuana deal. an autopsy is expected to be performed today. police are searching for suspects in that case. pittsburg police continue looking for three suspects involved in a recent deadly shooting that took place at a gas station. 24-year-old robert grant, brian fox and 19-year-old demetria

thomas wanted in connection with that murder. timothy smith, jr., was killed outside the station. police have not released a motive. the three suspects are known to frequent san francisco and oakland. now to a story you'll only see on nbc bay area. the man behind a gun store in one of the south bay's priciest neighborhoods is now the target of death threats. "today in the bay's" marla tellez is live in los gatos with what the store owner is saying. good morning, marla. >> reporter: laura, good morning. the attorney for owner robert chang says that his client has been forced to take extra security precautions and that includes notifying police here in los gatos and police in san jose where he was actually threatened. templar sports opened back in december. this has been a big story. it's considered a sporting goods store but because it sells guns, it attracted heat from hundreds of people who live here.

just this past monday, hundreds turned out for a town council meeting where they demanded a business move or shut down all together. the next night on tuesday night if owner robert chang received a letter at his home in san jose that included a death threat. now his attorney is worried about the next town council meeting where chang will be questioned once again. that special meeting is scheduled for this coming monday. >> i suggested that they delay monday's meeting. that would give the chief an opportunity and los gatos police department an opportunity to take whatever security measures that they want to. >> reporter: now chang is one of three owners but he has refused to publicly identify the other two so far and now chang's attorney says the death threat only validates his decision to try to protect his partners. sort of an interesting twist. one is a los gatos police officer. in regards to the legitimacy of the business being here on university avenue in los gatos,

town leaders say that chang and the other partners have secured all of the proper licenses and permits. live in los gatos, marla tellez, "today in the bay." the feds may take another shot at a former san francisco crime lab tech accused of stealing cocaine. they have until february 15th to decide whether to retry deborah madden. this would be the third attempt. the past two trials have ended in hung juries. madden's arrest in 2010 forced the district attorney to drop hundreds of criminal cases. san jose's mayor will outline the plans for the city today. mayor chuck reed will his give address. he is expected to call on leaders to accept a sales increase for the november ballot. the money would help support city services and restore pay to workers who agreed to pay cuts to help balance the budget. a recent poll shows 70% of people in san jose would support a sales tax increase. that's the highest level of

situated between concord and the east bay. mostly dry in san jose. we'll have to wait until 11:00, 12:00, before we get light rain down here. once this comes through, the cold blast follows behind it. temperatures aren't going to be that warm today. you'll need your jacket. grab that umbrella as well. 54 degrees in livermore. 55 in gilroy. 56 in santa theresa. we want to help you make weekend plans. we don't have any rainfall to contend with over the course of the weekend. we do have changes headed our way. i'll time that out for you coming up. first as promised, he's going to be a busy man. especially today. >> good morning. christina is talking about that rain. judging by the radar flow and timing that christina talked about, tail end following most of the commute. the rain will head 8:00 where things start to simmer down just after that. just be prepared. maybe leave earlier for your commute if you can. right now we're looking over here to the bay bridge and smooth drive. a light flow of traffic. maps did have a bit of slowing on that upper deck around the s-curve which it should.

that's down toward 50. we have construction both directions blocking a couple lanes for 880 through oakland. that's between high street and fifth. no real issues until they start to move that equipment in another half hour. you might see slowing or i might and i'll show it to you if i do. south 680 is the direction that got corrected here. south 680 with a crash over at marina cleared from all activity. it is cleared from lanes. that's good news. live look shows you north bay with flow here southbound 101 picking up a few cars. enough to show you the flow of traffic now. no delays san rafael from novato and highway 37 down to this point. back to you. >> thanks a lot, mike. here's a heads-up here. if you are planning to take ferry service to and from san francisco and vallejo, your morning commute is going to be delayed. two of the four ferries are out of commission. one for mechanical problems and other for routine maintenance. full ferry service should be back up and running later on today.

the creator of the bay lights bay bridge project will offer insight into his artwork tonight. he'll talk about his project when he stops by the museum of modern art. that event will start at 7:00. nearly two miles of lights illuminate the north side of the bay bridge western span. still in the testing phase but a full display is scheduled in march. that is an inspiring display. it's very cool. we've seen testing. i like that. looking forward to it. 5:10 right now. we can also tell you the celebrities are out. find out where you can stargaze all along the coast this weekend. one of those celebrities also selling her malibu dream house. we'll look at the price and how you can get it coming up.

early in the morning. it's early. 5:13 right now. there's a lawsuit working its way through federal court in chicago that could soon effect the way people across the country do business. at issue, whether reading e-mails on your smartphone and answering calls after hours constitutes overtime. the suit was filed by chicago police sergeant who says the city owes him and his other officers because overtime work he did on a department issued blackberry. the suit was filed in 2010 but a u.s. magistrate recently ruled the plaintiff ordered sufficient merit for that lawsuit to actually continue. this one is an issue that effects all kinds of companies. scott mcgrew, best buy ran into the same kind of problem as well. >> best buy launched a twitter account where any best buy employee can go on and answer questions and some thought it was fun they would do it after work from home. best buy had to tell them to

knock it off because he was worried about chicago pd that an employee would say years later i should have been paid overtime for that. microsoft this morning launching a new ad campaign to criticize google's g-mail practice of serving up ads based on what's in your e-mail. if you talk to a friend about going to the gym, you may see a banner ad for 24-hour fitness. g-mail has always worked that way. yelp getting much bigger. it added 26 new cities in the last three months and says lots of people are using its mobile app. it continued to lose money burning through 5 million in the last quarter. that stock down this morning on that news. let me repeat, the company's mobile strategy is going very well. facebook does the opposite. it makes money but haven't solved mobile. the opposite of yelp. investors don't like that either. let's turn to bertha coombs live at cnbc world headquarters.

good morning. >> good morning, scott. investors seem to be waiting to see what the next catalyst is going to be. futures more or less flat this morning. stocks yesterday flat. the latest round of earnings really fail to inspire investors except for handful of names. we'll get data on unemployment, productivity, labor costs and consumer credit. we'll get numbers in 15 minutes or so. the dow ended the day in the black just getting positive at the end of the session. up seven points to 13,986. here we're all watching winter storm nemo. already disrupting airlines. folks changing their flights. a lot of folks going to the grocery store to hunker down this weekend. >> all right. thank you much. it will be about 70 today, right? >> i wish. barbie is moving out of her malibu home listing her dream house on the real estate website trulia for $25 million.

you will get isolated showers in uk ukiah area. that activity doesn't come into sonoma county until 8:00 a.m. this morning. future cast tells that story. we stop the clock into noon and lunchtime make sure you have that umbrella with you especially in the south bay and east bay with showers around. continue that future cast stop throughout the second half of the day. we'll see lighter, spotty activity and then the cold blast follows behind. 1:00 a.m. on friday, future picking up snow. we have a chance to see snow levels drop tomorrow morning to 500 feet. we'll be watching on the valley floor for possibly a mix of rain and snow. 2:00 p.m. friday as we head throughout the afternoon, showers lighten up and then the really cold air comes into play. on saturday morning we'll have clear skies. no blanket of low clouds to trap in any sort of warmth. we'll be waking up near record cold. make sure you're ready for that.

bring in the sensitive plants as we heads through the weekend as frost will be a factor. today's high works like this. 57 in san jose. 53 in oakland. 54 in fremont. seven-day outlook tells the story. cold morning saturday and sunday. nice, sunny finishes. monday into tuesday we'll warm up just a little bit and we get another system wednesday into thursday of next week. 5:19. it was as rough drive yesterday morning. hopefully we can ease that for you with mike. >> 5:20 in four seconds so we still easy drive as far as flow of traffic goes. we do have to point out road crews. i don't have to. i like to tell you about them. this is capital expressway off 101. unlike yesterday there's no slowing showing up on sensors. they may have to move the crews in half an hour and that could cause slowing. i'll track that for you. 87 northbound to northbound 280, that connector is closed and it has been for the last couple of mornings. until 6:00 a.m. there are some metering lights going on including at that transition so next week we'll

bring changes and we'll track those for you as well but right now it's just a closure. use the downtown exit to loop around. 8808 northbound off 237 that connector is still closed but you get off and get on 808 to the north. it's right there. follow freeway signs. we'll look at tri-valley with a smooth drive. no slowing yet out of livermore and into pleasanton. altamont pass shows a build and slowing there. smooth drive toward san mateo bridge. we'll get a look at this flow westbound through the peninsula and end with one more shot from the peninsula that's palo alto. easy drive. i'll show you that bay bridge coming up in my next report. back to you. it is 5:21 right now. on capitol hill the senate armed services committee planning a key hearing resolving vooe inii that september 11th attack in benghazi. they are scheduled to testify about the findings of the defense department's internal review following that attack. if you recall, a total of four

americans died in the incident including ambassador and bay area native christopher stevens. we should learn more about into the investigation of the battery problems with boeing's 787 dreamliner later today. that's when the ntsb will hold a news conference to update the progress. the faa grounded all dreamliner last month. "the wall street journal" reports boeing is working on a battery design change to try to minimize fire risks. it is 5:21 right now. coming up, the new rules of the road. the chp cracking down on motorcycle lane splitters. you've seen them.

we also like to call it friday eve. that's a very cool shot. one of the snapshot moments. it's 5:24. a daly city woman in trouble this morning for allegedly forging the signatures of dozens of san jose city officials. she was hired to collect signatures to get measure d on the november ballot. the district attorney's office says she forged the signatures of 80 city leaders in order to get that measure on the ballot. measure d passed in november raising minimum wage to $10 an hour in san jose. a judge says if she doesn't report to court today, he'll issue a bench warrant for her arrest. motorcycles pass cars driving on the white line between the lanes. california is the only state where it is legal because there's no specific law that forbids it. now the chp has posted the first ever written guidelines on their

website. among those guidelines motorists should not pass in traffic that is going more than 30 miles an hour. motorcyclists on freeways should only lane split between the two fast lanes where vehicles are less likely to change lanes. and other drivers should not try to stop a motorcycle from lane splitting. >> guidelines, not laws. interesting. >> you have to be ready. >> it is scary when they come zooming through there. all right. mike inouye is here. going to split lanes for us the conventional way. >> splitting hairs on the commute. subtle difference in your drive. guidelines on my facebook page because people are always ask about lane splitting. over here no need for any of that. traffic flow through fremont is fine. light volume. headlights southbound past truck scales. taillights away from us are southbound. commute direction. few going north are heading up past highway 84 with a report of

a very good morning to one and all. 5:30 right now. thank you for joining us. i'm jon kelley. >> i'm laura garcia-cannon. we begin with breaking news we're following in southern california where three officers have been shot apparently by a man wanted for killing a college basketball coach and her fiance. we just learned that one of those officers has died. the shootouts happened early this morning. one in corona, two in riverside. the suspect is a former police officer on the run after the shooting deaths of that coach at cal state fullerton and her fiance. police say former lapd officer christopher dorner wrote a multipage manifesto linking himself to the killings. there's a strange twist to the killings. the father of the basketball coach who was killed represented the suspect in a hearing that resulted in the suspect being fired from the l.a. police department back in 2009.

happening right now, south bay police involved in a manhunt of their own. a parolee in police custody this morning manages to give officers the slip. "today in the bay's" christie smith joins news san jose with exactly what happened. a wild scene, christie. >> reporter: good morning to you, jon. anthony sanchez saw an opportunity and he grabbed it. he was under arrest in handcuffs inside of an unmarked police van but when police officers were outside of that van doing paperwork, he was able to give them the slip and actually take off in that van. police say they had double cuffed him. two sets of handcuffs together to ease the stress on his shoulders and he took advantage of that and rolled off in that van. police tell us it started about 3:30 on hillsdale avenue here in san jose. he had been arrested on a drug related warrant and sanchez is a big guy but was able to move cuffs under his body and get away. the keys were in the ignition at the time.

two hours after this, they were able to locate the van. fortunately nothing was stolen from it but sanchez is long gone. he's 5'8", to 5'10" tall, 250 to 275 pounds. he was wearing black sweats and a gray sweatshirt. he may still have cuffs on but he also could have slipped those off too. he isn't considered dangerous. we do have calls into san jose police and of course we're here at headquarters and as soon as we hear from them this morning, we'll let you know what they had to say. live in san jose, christie smith, "today in the bay." more details about the mysterious death of a fairfield teenager. the body of genell conway allen was found on friday. the fbi has joined in the

investigation. fairfield police say the case is moving forward but not ready to share what has been uncovered. they are thanking the community for their support during a very painful period. san francisco police need their help working to solve the decades old case of the disappearance of kevin collins. they think collins was abducted from a bus stop in 1984. a man is now described as a person of interest in this case. investigators only recently discovered a full criminal history because he used several aliases. collin's family says the possible breakthrough is bittersweet. >> it's bittersweet to think about it because it's more information and possibly answers the question of what happened to kevin. >> steven collins says he would like to have the case settled definitely because family members need closure in this

case. some of them still keeping home kevin will be found alive. only on nbc bay area, the fight over whether a gun shop can do business in los gatos is now leading to death threats delivered to the home of the shop's owner. marla tellez is live in los gatos with reaction from that owner. good morning, marla. >> reporter: laura, good morning. templar sports opened in december and owner robert chang has taken heat from people not happy that he opened shop here on university avenue in this quaint town. now for him the focus is less on his business and more on his personal safety. the latest debate over whether templar sports should be forced to move or stop selling guns took place at a town council meeting this past monday night. hundreds of people turned out for that. chang was there and questioned by the council at length. the next night on tuesday, he received a letter at his san jose home that included a death threat. his attorney tells us they're not taking this lightly but at

the same time this is not going scare chang away from los gatos. >> this just does not deter robert. robert is not just a businessman. he's also a civil rights advocate. i suggested they delay monday's meeting. that would give the chief an opportunity and los gatos police department an opportunity to take whatever security measures they want to. >> reporter: right there chang's attorney was just referring to the next town council meeting where chang is expected to be questioned yet kweagain. he's hoping town officials will delay until los gatos police can make sure that chang is safe. chang's attorney is in touch with los gatos police but also in touch with police in san jose because that's where chang was threatened. live in los gatos, marla tellez, "today in the bay." >> the state has fined a south

bay hospital for failing to treat a patient who was in ca cardiac arrest. the patient went untreated for a total of nine minutes at the santa clara medical center in san jose. he was revived but he did suffer a severe brain injury and then later died when the family took him off life support. the state has fined the medical center $100,000. ucsf medical center in san francisco received two fines totalling $200,000 in both instances patients underwent a second surgery to remove a foreign object. the state fined st. mary's medical center in san francisco twice. once for leaving a foreign object in a patient and once for failing to properly distribute medicine to a patient. a little rain headed our way. enough to make a big difference? >> certainly. we'll see 36 hours of showery activity. you don't want to wash your car by any means.

this front will drive in cold air as well. you'll notice the difference as we take you through your day hour by hour forecast tells the story. nice and dry at this point. just a few hours away from showers arriving in sonoma county. stop the clock on future cast. tells the story at 8:00 a.m. most of the activity still to the north of the golden gate bridge but the front will bridge about steady rainfall to the north bay starting at 8:00. by 11:00 a.m., the front moves south. livermore to san jose getting first showers and once it starts like i said before, about 36 hours of showery conditions in the bay area before that sunshine returns. we stop the clock for you at 3:00 p.m. showers will lighten up at that point. won't be as steady. we'll have a few on and off areas. a couple cells streaming onshore as we head throughout the day today. highs work out like this. 54 degrees in livermore. about 56 degrees in places like fairfield and 55 in gilroy. as we head through the weekend, temperatures tumble to near record lows. and if everything times out just right, we might be tracking snow showers as low as 500 feet right

here in the bay area. also will look at fan fest forecast coming up in my next report. let's check in first with mike and the morning drive. >> the commute is starting to build right now on 880 past the coliseum northbound past high street into downtown. moves smoothly. map shows you headlights coming the southbound direction. i circled the coliseum at the bottom of the map. we see sudden slowing over the last five minutes. crews scheduled to move about now. road crews between fifth and downtown all of the way down toward high street expect a little slowing there. reports southbound 13 at lincoln avenue. reports of swerving around a tree in the area. they may have to block a lane to remove that. so far no word from chp. still heading slow westbound 580 building to the dublin interchange. we'll end with this shot and show you south bay coming up. back to you. >> thank you very much. it's 5:39. you may soon have a chance to walk across the new span of the

good thursday morning to you. president obama's nominee to head the cia will be in the hot spe seat when he goes been a senate panel confirmation hearing later this morning. tracie potts is here now. >> john brennan is the president's top counterterror adviser and right in the middle of this big issue of the use of unmanned drones to track down and kill terror suspects even if they are american citizens. democrats and republicans here have big questions about that. the administration just on the eve of his questioning of his confirmation hearing today released what was a confidential classified memo explaining why the government thinks this is legal and why it's justified. he's likely to face questions about that today. also, brennan was at the cia for

25 years and worked under the bush administration when there were lots of questions about the interrogation tactics the cia was using on terror suspects. think waterboarding. remember that? he's going to face questions about that as well and in a written response to the committee not only does he defend the use of drones but brennan also says back then he had some concerns about those interrogation tactics and he raised those concerns to his colleagues in private so we're likely to hear about more of those. >> interesting to see. thank you very much. it's 5:43 right now. it's time to tee off. hollywood sides and pro golfers collide this morning in pebble beach. >> not literally. players taking part in this year's at&t pro-am. always fun to see. one guy that heads out there is bob redell. he's live at pebble beach this morning where tournament play starts this morning. are you ready? >> reporter: i don't know if they would let me out there.

good morning. first tee time around 8:00. we're at the practice tee for the first hole of the pebble beach course. some of the people you will not be seeing out here practicing this morning, some of the notable exceptions professionally no tiger woods. celeb-wise, no george lopez or kevin costner. this guy right here, you can see hi name on the plaque. winner of last year's pro-am, phil mickelson he'll be here to defend his title and so will bill murray, jim harbaugh and newcomer, former secretary of state condoleezza rice. yesterday was the pebble beach celebrity challenge. an opportunity for the celebs to become familiar with the course and perhaps calming nerves they may have about playing with the pros today and to raise money for charity. huey lewis, a regular here at the pro-am, earned props from the gallery as he chipped in to win the challenge on the final hole. >> i would like to have this one right here on thursday.

you can see devastation. six people killed by the five-foot waves that smashed right into that island yesterday. it flattened everything in its path including at least five villages. the tsunami was triggered by an 8.0 quake. that area still very much dealing with the aftershock this morning including a 6.0 quake that hit at about midnight our time. the sacramento kings move to seattle is all but certain this morning. the team is formally filed for permission to relocate. nba commissioner david stern says the application from the seattle group is very strong. three weeks ago the family sold the team to investors in seattle. they are still working on a plan to keep the team in town. >> sounds like changes are coming. a major milestone for apple's itunes. >> airline news including cheaper flights. we'll take a look in business

would include computers sold to businesses. a lot of airline news to pass on to you this morning. keep in mind there's a big storm headed toward the east coast. many airlines are allowing you to rebook now for free as they expect winter storm nemo to shut down airports. japanese airline ana as extended cancellation of service out of san jose all of the way through march. the plan was to fly 787 dreamliners between san jose and tokyo and 787s as you know are grounded from commercial flight. several news reports say american airlines is this close to buying u.s. airways. the new airline probably called american would then become the largest airline in america. and southwest just lowered prices on some of its flights between san jose and los angeles to $49. this matches virgin america's price aforesaid that airline announced it would move into the

good morning, everybody. thank you for joining us. i'm jon kelley. >> i'm laura garcia-cannon. that breaking news is in riverside county in southern california where a police officer is dead and two other officers are hurt after a shootout and a suspect on the run. the suspect is a former lapd officer who allegedly shot and killed a cal state fullerton basketball coach and her fiance. the shootout with police happened early this morning in the city of corona and the city of riverside. police say this man, former lapd officer christopher dorner wrote a multipage manifesto linking himself to the killings. there's a strange twist. the father of the basketball coach who was killed represented the suspect in a hearing that result eed in the suspect being fired from the police department in 2009. we're hearing reports of an
